That means that any operator/entity that processes personal data must apply these new requirements and offer information in a transparent way regarding the way the data is processed.

1.WHAT IS A “COOKIE”?

An “Internet Cookie” (a term also known as “browser cookie” or “HTTP cookie” or just “cookie”) is a file of small dimensions, made from letters and numbers, which is stored on the computer, mobile phone or other equipment of a user from which the internet is accessed. The cookie is installed through the request emitted by a web server towards a browser (ex: Internet Explorer, Google Chrome, Mozilla Firefox) and is completely “passive” (it does not contain software, viruses or spyware and it’s information cannot be accessed from the user’s hard drive).

A cookie is a format made from 2 parts: the name and content or the value of the cookie. More than that, the life span of a cookie is determined: technically, only the server that sent the cookie can access it again in the moment that a user comes back to the site associated with the web server.

Cookies play an important role in facilitating access and delivering the multiple services that the user enjoys on the internet, such as:

  • Personalizing certain settings such as: the language in which a site is viewed, the currency in which prices or rates are shown, keeping options for various products (quantity, other details, etc.)
  • Cookies offer site owners a valuable feedback of how their sites are used by the users, so that they can make them more efficient and more accessible to users.
  • They allow multimedia other kind of applications from other sites to be included in a certain site so as to create a navigation experience that is more valuable, more useful and more pleasant.

Cookies themselves do not request personal information so it can be used and, in most cases, do not personally identify the internet users.

There are two big categories of cookies:

  • Session cookies – these are temporary stored in the cookie file of the web browser so it can memorize them until the user exits the website or closes the browser’s window (ex: the moment you log in/log out from a webmail account or on social media networks).
  • Persistent cookies – there are stored on the hard drive of a computer or equipment (and, generally, they depend on a prescheduled life span for a cookie). Persistent cookies include also the ones placed on another website than the one that the user’s visiting at that moment – known also as “third party cookies” – which can be used anonymously for memorize the interests of a user, so that more user-relevant publicity can be delivered to the users.

Cookies are administered by web servers. The life span of a cookie can vary significantly, depending the purpose for which it has been placed. Some cookies are used exclusively for a single session (session cookies) and are not memorized once the user has left the website and some cookies are kept and reused every time the user return to that website (“permanent cookies”). Although, cookies can be deleted by a user at any moment though the browser’s settings.

Generally, the role of the cookies is to ensure a fast and easy interaction between users and their websites. Also, cookies are used so that the user can easily resume his activities during the next accesses of a web site, see previous. Practically, cookies tell the server what pages they should show the user, without him being needed to remember the pages where he navigated or him being needed to navigate through the whole site from the beginning.

Session cookie

Session cookies are stored in the user’s device during a navigation session. These store session anonymous identifier, permitting the user to visit a web site without it being necessary to enter the identification information on every page (user name, password, etc.).

Such cookies are frequently used in an online store but not only. For example when the user visits a certain page and selects certain products, the cookie remembers the selected products and adds them in the shopping cart, which will contain all the selected products the moment the user will want to leave the page.

Session cookies are stored in the device’s memory only during one navigation session on the internet and are deleted when the browser is closed. Also, they can become inaccessible if the session has been inactive for a certain period of time.

5.WHAT KIND OF INFORMATION IS STORED AND ACCESSED THROUGH COOKIES?

The cookie stores important information that improve the internet navigation experience (for example: the user’s session ID, the referral page, current time, etc.).

Refusal or deactivating cookies does not mean you will not receive online publicity – only that this will not take into account your preferences and interests, highlighted through the navigation behavior.

Examples of important cookie uses (that do not require authentication of a user through an account):

  • Offers adapted to user interests – Romanian language preferences (for example, displaying search results in Romanian).
  • Supplying publicity that is more relevant to the user.
  • Measuring, optimizing and analytics characteristics – such as confirming a certain level of traffic on a website, what kind of content is visualized and the way a user gets to the website (for example: through search engines, direct, from other websites, etc.). Websites run these analysis of their use to improve the site to benefit the users.

7.SECURITY AND PROBLEMS REGARDING CONFIDENTIALITY?

Cookies are NOT viruses! They use “plain text” format types. They are not made of pieces of code so they cannot be executed nor auto-played, thus, they cannot duplicate or replicate on other networks so they can run or replicate again. Because they cannot fulfill these functions, they cannot be considered viruses. Cookies can still be used with negative purposes. A lot of anti-spyware products are conscious of this and constantly mark cookies to be deleted during the deleting/anti-virus/anti-spyware procedures.

Generally, browsers have integrated confidentiality settings that provide different levels of cookie acceptance, period of validity and automatic deleting after the user has visited a certain site.

Personal stored data will be used to run contracts and process your requests. After finalizing the run of the contract or your request, the data is saved taking into account the storage terms according to the fiscal and commercial legislation and where the case is necessary for a period required so as to protect the Operator’s rights.
